It also draws a parallel between the work of the Italian philosopher and Octavio Ianni’s sociological studies, mainly concerning to “modernidade-mundo” (world- modernity). It further outlines digressions on the present phase of International Law, characterized by the Westphalian Conventions and the possible post- Hobbesian order, especially on jus cogens international norms, State voluntarism and the efficacy of international law in protecting human rights. Finally, working from the Habermasian idea of a global public sphere, it takes up the dialogue with Marramao on criteria for universality and difference.pt-BRDesterritorialização e reterritorialização do direitoGiacomo MarramaoVoluntarismo estatalEsfera pública globalDesterritorialização do direito: voluntarismo estatal e esfera pública globalDeterritorialization of law: state voluntarism and global public sphereArticle
