It is a thorough jurisprudential analysis, analyzing the reasons and grounds used by the superior court when deciding to make a legal requirement more flexible. The Federal Constitution and the Statute of Children and Adolescents were the main sources of this legislative research, in addition, the understanding of scholars about the subject is also extremely important and, finally, the judgments of the Superior Court of Justice.
