Resumo
This article discusses the theoretical study concerning the analysis of sustainability in the legal field, with the primary objective to present the contributions of environmental law for sustainable development. Therefore, we developed a theoretical study, through literature and documentary research in the legal research sources contemplating: legislation, doctrine, case law and comparative law. At first we present a fast approach of legal developments at the national level, whose origins date back to legislation from Portugal. Subsequently, founded on the right to sustainable development as a normative principle of the Brazilian Federal Constitution, adapting to both the economic and financial order and social order, referring specifically to the environment. Through this study, it is observed that environmental legislation in the country is widespread and can be considered sufficient to ensure the preservation of the environment conditions; however, the letter of the law alone is not enough: it is necessary legal instruments to ensure their applicability.
