Resumo
This study presents initial reflections on
Giacomo Marramao’s contributions to International
Law, particularly regarding to an understanding of the
deterritorialization and reterritorialization of Law, which
goes back to studies by Deleuze and Guattari on these
concepts. It also draws a parallel between the work of
the Italian philosopher and Octavio Ianni’s sociological
studies, mainly concerning to “modernidade-mundo”
(world- modernity). It further outlines digressions on
the present phase of International Law, characterized
by the Westphalian Conventions and the possible post-
Hobbesian order, especially on jus cogens international
norms, State voluntarism and the efficacy of international
law in protecting human rights. Finally, working
from the Habermasian idea of a global public sphere, it
takes up the dialogue with Marramao on criteria for universality
and difference.
