dc.description.abstractThe purpose of this dissertation is to investigate if the brazilian Judiciary plays its role in guaranteeing human rights to adequate food and to the ecologically balanced environment through the internalisation of negative externalities resulting from the use of pesticides. For this, the first chapter sought to understand what human rights are, showing this concept and foundations based on the traditional theory and then presenting the vision of the critical theory of human rights. From that point on, it has been shown how the recognition was achieved and how has been happening the redetermination of the human right to adequate food and to the ecologically balanced environment. Next, the role of the Judiciary and its contribution to the effectiveness of human rights were discussed, analyzing some aspects of the Brazilian Judiciary's performance and characteristics. In the second chapter, it was demonstrated how the use of pesticides in agricultural production began in Brazil, trying to show how the Brazilian State, especially the governments of the military regime, played a fundamental role in the adoption of the precepts of the green revolution and the advancement of agribusiness in the country. From that point on, the concept of negative externalities was discussed, exposing how this phenomenon happens through the use of pesticides in agriculture, and demonstrating that it violates human rights to adequate food and to the ecologically balanced environment. Also, some forms of internalisation of negative externalities were pointed out, showing the idea of the contribution of the Judiciary in this process. Finally, in the third chapter, we analyzed the Judiciary's performance through the investigation of judgments of the Federal Supreme Court and Superior Court of Justice, seeking to identify the position of these Courts regarding negative externalities, the fight against the use of pesticides and the guarantee of human rights.eng

dc.description.resumoA presente dissertação teve como objetivo investigar se o Poder Judiciário brasileiro exerce o seu papel na garantia dos direitos humanos à alimentação adequada e ao meio ambiente ecologicamente equilibrado por meio da internalização das externalidades negativas decorrentes do uso de agrotóxicos. Para isso, no primeiro capítulo buscou-se compreender o que são os direitos humanos, mostrando seu conceito e fundamentos com base na teoria tradicional e, em seguida, apresentando a visão da teoria crítica dos direitos humanos. A partir daí, demonstrou-se como se deu o reconhecimento e como vem acontecendo a ressignificação dos direitos humanos à alimentação adequada e ao meio ambiente ecologicamente equilibrado. Em seguida, abordou-se o papel do Poder Judiciário e a sua contribuição para a efetividade de direitos humanos, analisando alguns aspectos da atuação e características do Judiciário brasileiro. No segundo capítulo, demonstrou-se como teve início a utilização dos agrotóxicos na produção agrícola do Brasil, procurando evidenciar como o Estado brasileiro, em especial os governos do regime militar, tiveram papel fundamental na adoção dos preceitos da revolução verde e avanço do agronegócio no país. A partir daí, tratou-se do conceito das externalidades negativas, expondo como esse fenômeno acontece a partir do emprego de agrotóxicos no campo, bem como demonstrando que viola os direitos humanos à alimentação adequada e ao meio ambiente ecologicamente equilibrado. Ainda, apontou-se algumas formas de internalização das externalidades negativas, trabalhando a ideia da contribuição do Poder Judiciário nesse processo. Por fim, no terceiro capítulo, passou-se a analisar a atuação do Poder Judiciário por meio da investigação de julgados do Supremo Tribunal Federal e Superior Tribunal de Justiça, buscando identificar a posição desses Tribunais quanto às externalidades negativas, o combate ao uso de agrotóxicos e a garantia de direitos humanos.eng
