In this way, the focus is judgements on Second Instance, about moral damages and situations of conflicting verbal interaction. The way values are considered by judges during judgements is important in the description that we propose here. The main objective of the present paper is to describe how argumentation is built in an argumentative situation (PLANTIN, 2008). It is also intended to describe macro discursive and interactional phenomena of discourse and the contra discourse of interactional argumentation (CARIZZO, PLANTIN) presented for analysis. The theoretical contribution starts from the sociology of verbal interactions, through classical studies on linguistic politeness (BROWN AND LEVINSON, GOFFMAN, GRICE) and some contemporary interpretations (KERBRAT-ORECCHIONI, TRAVERSO, AMOSSY). Our search includes theories from legal and rhetorical philosophers (PERELMAN) and jurists who care about the performance of magistrates and how they deal with their emotions (GARAPON, DUPRET, POSNER).
