It is not an easily identifiable value, but a rather complex composition, which stems from an interpretative construction fruit of the interaction between text (technical issues and law) and reality. The objective of this article is, once understood that the legal concept of fair compensation promotes a specific construction of market value, to investigate the possibility of overcoming the criticisms made to the indemnity for said value, without failing to comply with the constitutional mandate of fair compensation. The research is bibliographic and documentary, and the approach is hermeneutic (philosophical and legal). The conclusion is that the legal concept of fair compensation promotes a specific construction of what is market value for theuniverse of expropriations.El presente trabajo pretende explicitar la comprensión sobre cómo se concreta el valor de mercado en el contexto de las expropiaciones, desvelando como se construye. No se trata de un valor fácilmente identificable, sino de una composición bastante compleja, que surge de una construcción interpretativa fruto de la interacción entre el texto (cuestiones técnicas y el derecho) y la realidad. El objetivo de este artículo es, una vez entendido que el concepto jurídico de indemnización justa promueve una construcción específica del valor de mercado, investigar la posibilidad de superar las críticas hechas a la indemnización por dicho valor, sin dejar de cumplir el mandato constitucional de la justa indemnización. La investigación es bibliográfica y documental, yel enfoque es hermenéutica (filosófica y jurídica).
