Resumo
This study aimed to analyze the institutional violence perpetrated against women in the
justice system, as well as the responsibility of the State in cases of negligence by its agents,
based on the case of the teenager Lidiany Alves Brasil, which occurred in Abaetetuba, in
the state of Pará, in 2007. It is undeniable that violence against women is a social
phenomenon, increasingly accentuating gender inequalities, having been the agenda of
several social movements, especially feminists, responsible for the creation of
international and national policies on protection of the human rights of girls and women.
However, it is noted that when the disrespect of these rights comes from the State itself,
the problem is accentuated, considering that the person responsible for ensuring and
enforcing the rights of the individual is the violator of rights, punishing those considered
in a situation of vulnerability doubly. Therefore, it is concluded that the violations of the
rights of the adolescent Lidiany clearly demonstrate the perpetuation of a patriarchal and
sexist society within the justice system, and it is possible to evidence the negligence and
omission of the State, which contributes to the maintenance of the cycle of inequality and
gender violence. For the construction of the present study, bibliographical and qualitative
research was used, with the use of works for the analysis of violence against women and
girls within the justice system and the responsibility of the State from the case of the
adolescent Lidiany.
