Resumo
The proposal of the study is to demonstrate
that the access to the judgement, right of the citizen in
the democratic State of right, is inexorably, half efficient
of promotion of ambient justice in the agrarian way. This,
in turn, is closely on question to social justice and it is
only feasible through the fulfilment of the social function
of the agricultural property. For such necessity it is
presented reorganization of the judiciary organization, in
some States and the federal sphere, made possible for the
disposal of art.126 and its only paragraph of the Federal
Constitution that foresees the creation of the specialized
Agrarian Poles and itinerantes Agrarian Courts.
