Resumo
This paper analyses the judge’s impasse of having to serve justice, by duty of
consciousness and for having to apply the law, even when it is unjust, as an obligation of
his position. Placing the discussion of the difficult relationship of the judge and the law
upon the iniquitous ethos of the social, the article concludes that we all have, even more
the judge, by the nature of the responsibilities that are for him uncompromising, the
moral duty of having to serve justice – duty which is above all juridical imposition – in lieu
of a more ethical society.
