Resumo
Insider Trading is a practice of trading securities by internal users, based on the knowledge of privileged information, that is, information not disclosed to the public. Law no 10.303/2001 classified such practice as a crime, with a prison sentence of one to five years, in addition to a fine of 3 times the amount obtained illegally. This device is recent in relation to the Financial Market. There is some difficulty in imputing such conduct to the active agent. This project aims to analyze the application of criminal law in the crime of Insider Trading, seeking to verify the application of Brazilian law in the practice of crimes involving privileged information. To achieve this objective, a bibliographical review will be carried out. From this analysis, it is expected to verify if the Brazilian legal device presents applicability in the repression of such conduct.
