Resumo

The object of study of this dissertation, is the Program for Integral Attention to the Transgressor Patients with Mental Disorder (PAILI). This program has as its goal the social reintegration (Public Ministry of the State of Goias, 2009) of patients with mental disorder with history of transgressor act, or judiciary patient, as we prefer to call them. We focus to analyze the history of legal transgressions motivated by mental illness in Europe in XVIII and XIX centuries and in Brazil in XIX and XX centuries. In this sense, we studied the problem of the scientific and cultural secular tradition to considered madness as a common place of danger, violence, and appropriated for abuses, abandonment and incarceration. We consider all this process has developments over PAILI due to the work of this Program against that tradition, which occurs by the legal order of the Brazilian psychiatric reform. So, we worry about the aimed socialization of the judiciary patient. The formative reaching of the official discourse of the State is investigated, from the content considered potentially socializing of the judiciary patient, found in four main documents for the PAILI working: the law nº 10.216 (the Brazilian antimanicomial law), the PAILI s Primer , the agreement term to implantation of the PAILI and the decree law 019/2006 (which creates the PAILI administratively subordinated to the Department of Health of the State of Goias). It is concluded that the studied documents reveal the contents potentially inclusive of the PAILI towards socialization of the judiciary patient; however this potential is limited by historical, social and economic macrodeterminations formed by liberal democracy.
