Resumo

The education, as the child’s right and the responsibility of the State was consolidated by the French Revolution. In Brazil, this was guaranteed later, and although there have been improvements in the public policies in the last fifteen years, many youngsters do not go to school. In this way, this study intended to discuss the profile and the right to education of youngsters who have been sentenced to correctional measures without freedom restraint, mainly the measures of social service in the city of Anápolis, in the context of public policies. We aimed to understand how the right to education is guaranteed to the youngster who has committed an offence and is sentenced to community service. In order to fulfill what was intended, we carried out bibliographical and documental research, taking into consideration the records of assistance of the youngsters in conflict with the law, available in the Centro Especializado de Referência em Assistência Social – CREAS. We also interviewed the judge of the Child and Youth Court of Law of Anápolis; the coordinator of correctional measures of CREAS; an orientator of the community service measure of CREAS and ten young people, one girl and nine boys. We reached the conclusion that although valuable efforts have been made up to now, it is necessary to reformulate the correctional practice without freedom restraint and its plan of attending, mainly concerning the intersectoriality of the public policies.
