Resumo
Introduction: among the functions provided in the Brazilian Republic Constitution to the Prosecutors Counsels (PC), the rights to health is highlighted, including in this context, the oral health of the population. In the same way, it serves the PC in repression of improbity acts concerning public managers involving budgets for health, more specifically on the responsibility for specialized public dental treatment.
Aim: the aim of this paper is to report a case that involves the dentist as a technical assistant to the Prosecuting Council. It describes a situation in which it is necessary an answer to a question in the investigation of management improbity in odontological treatment that has the payment authorized to be supported by the public health care system in a city of Rio Grande do Sul State (Brazil).
Conclusion: the odontological class and public managers must act ethically and respect the standarts and legislation that guide the public amounts concerning treatments in municipalty, otherwise they can be investigated by the public attorneys.
