dc.description.abstractThis research seeks to understand the formation of Agrifood Law and contribute to the construction of an understanding of matter in its foundational and conceptual aspect, taking into account in this process the existence of different realities to those under which this right is rising and structuring. The Agrifood Law that currently stands as a global parameter corresponds in truth to a regional right, built from European localities, with its specific economic, political and social interests. The centrality of the agri-food system in which it is inserted is in the aspect of agricultural productivity in an industrial way. In this logic, the agricultural establishment can soon be understood as an agrarian enterprise. But this industrialized model of production does not correspond to the totality of the productive realities of the world, and in the classical homogenization inherent in modern thought, the practices of development are marginal and invisible. In view of this, it is proposed to think from new epistemological bases, counteracting modern / industrial thinking focused on high productivity, in order to glimpse the diversity of productions existing in the globe. The Epistemologies of the South appear for this work as this new possible basis for rethinking the Science of Law that turns to the agrifood discipline. They corroborate with this intention the guidelines of the critical-methodological, argumentative line, with the accomplishment of bibliographical research. Thus the first chapter aims to present the Agrifood Right that is built from Eurocentric reality. The second identifies that standardization according to this parameter is incompatible with the diversity of the world's agriculture; the third chapter attempts to demonstrate how the election of a standard universal agricultural model masks other productive practices. The latter seeks to contribute to an understanding of Agro-Food Law as a space for convergence of different agri-food systems.eng
dc.description.resumoEste trabalho busca compreender a formação do Direito Agroalimentar e contribuir para a construção de um entendimento da matéria em seu aspecto fundacional e conceitual, levando em conta nesse processo a existência de realidades diversas àquelas sob as quais tal direito vem se erguendo e se estruturando. O Direito Agroalimentar que se coloca atualmente como parâmetro mundial corresponde em verdade a um direito regional, construído a partir de localidades europeias, com seus interesses econômicos, políticos e sociais específicos. A centralidade da sistemática agroalimentar na qual se insere está no aspecto da produtividade agrícola de modo industrial. Nessa lógica, o estabelecimento agrícola logo pode ser entendido como uma empresa agrária. Porém este modelo industrializado de produção não corresponde à totalidade das realidades produtivas do mundo e, na homogeneização clássica inerente ao pensamento moderno, as práticas destoantes restam marginais e invisíveis. Diante disso propõe-se pensar a partir de novas bases epistemológicas, fazendo um contraponto ao pensamento moderno/industrial voltado à alta produtividade, para vislumbrar a diversidade de produções existentes no globo. As Epistemologias do Sul surgem para este trabalho como essa nova base possível para repensar a Ciência do Direito que se volta à disciplina agroalimentar. Corroboram com esta intenção as diretrizes da linha crítico-metodológica, argumentativa, com a realização de pesquisa bibliográfica. Assim o primeiro capítulo objetiva apresentar o Direito Agroalimentar que se constrói a partir da realidade eurocêntrica. O segundo identifica que a uniformização segundo este parâmetro é incompatível com a diversidade de agriculturas do mundo; na sequência, o terceiro capítulo tenta demonstrar como a eleição de um modelo agrícola universal padrão encobre as demais práticas produtivas. O último busca contribuir para um entendimento de Direito Agroalimentar como espaço de convergência de diferentes sistemáticas agroalimentares.eng
