Resumo
Judicial decisions produce direct effects on the market, by increasing or
reducing the costs of economic trades, mainly in a country like Brazil, where the
Judiciary is the main arena of solution of conflicts of interests. In this scenario, the
Brazilians judges tend to be tolerant with relativizing the effects of laws and
contracts, modifying obligation in order to generate equity and practice social justice.
One of the main legal mechanisms for the judicial breaches of contracts is the Theory
of Frustration. An important legal instrument, which serves to prevent distortions in
contractual relations, gains a part at the expense of an excessive burden of the other,
the Theory of Frustration is often invoked by producers of agricultural commodities,
especially soya, to terminate or resurvey future sales contracts, one of the main
mechanisms of funding the Brazilian agribusiness. Occurs that opportunistic
breaches of these contracts create instability in the agricultural sector, producing
additional costs for production and causing loss of competitiveness.
