dc.description.abstractLaw n. 12,651 / 2012, established in the Brazilian legal system a new perception of ecological preservation, the establishment of Payments for Environmental Services (PSA) involves financial mechanisms for the protection of nature. In this context, considering that the social function imposed on rural properties provides for levels of agricultural productivity, some PSAs authorize properties to remain without production, only providing services that preserve nature. Given this, it is apprehended that the PES could release the fulfillment of the social function, and, therefore, prevent the implementation of agrarian reform. This work seeks to analyze whether this statement is necessary, if the PSA can, in fact, make the social function and agrarian reform unfeasible, due to dispensing with the agricultural productivity of rural properties. To this end, we seek to understand how the social function institute has been applied in the country, and how agrarian reform is being carried out, realizing, still, what the PES are and the proposal in which it is inserted, the green economy. The analysis will be based on the perceptions of Jose Gomes da Silva on land reform, Amyra El Khalili on the financialization of nature, and Ricardo Abramovay's conception of growth and green economy.eng

dc.description.resumoLei n. 12.651/2012, instituiu no ordenamento jurídico brasileiro uma nova percepção à preservação ecológica, o estabelecimento dos Pagamentos por Serviços Ambientais (PSA) envolve mecanismos financeiros para a proteção da natureza. Nesse contexto, tendo em vista que a função social imposta aos imóveis rurais prevê níveis de produtividade agrícola, alguns PSA autorizam que propriedades permaneçam sem produção, somente fornecendo serviços que preservem a natureza. Diante disso, é apreendido que os PSA poderiam desobrigar o cumprimento da função social, e, portanto, impedir a realização da reforma agrária. Nesse trabalho busca-se analisar se tal afirmativa se impõe, se os PSA podem, de fato, inviabilizar a função social e a reforma agrária, devido a dispensar a produtividade agrícola dos imóveis rurais. Para tanto busca-se compreender como o instituto da função social vem sendo aplicado no país, e como a reforma agrária está sendo feita, percebendo-se, ainda, o que são os PSA e a proposta na qual este vem inserido, a economia verde. A análise se embasará nas percepções de Jose Gomes da Silva sobre reforma agrária, de Amyra El Khalili sobre financeirização da natureza, e na concepção de Ricardo Abramovay de crescimento e economia verde.pt_BR
