    This monograph explores the protection of sensitive personal data under Brazil's General Data Protection Law (LGPD), focusing specifically on the incident in the e-SUS Notifica system. The study begins with an examination of the origins and underpinnings of the LGPD, placing the legislation within the context of global changes related to digital law and data privacy. It thoroughly analyzes the right to privacy as established by the LGPD, discussing the definitions and legal treatment of personal and sensitive data, particularly in the healthcare sector. Employing Miguel Reale's Three-Dimensional Theory of Law, the research contemplates the necessity for a legal approach that integrates norms, facts, and values to ensure adaptability and effectiveness in data protection in an ever-evolving digital environment. The monograph underscores the importance of effectively implementing data privacy governance programs, highlighting the consequences of a lack of preventive measures and the risks to human dignity. This research contributes to a critical understanding of the LGPD and its practical implications, offering insights into the adequacy of current regulations in the face of contemporary technological and social challenges, and emphasizing the need for a legal system that keeps pace with the digital society's dynamics.

    “É sobretudo a lei dessa Infinita highway”: representações de noções de direito no rock de Engenheiros do Hawaii

    This study aims to analyze the representations of legal notions present in the work of the band Engenheiros do Hawaii, covering the period from 1984 to 2008, demonstrating how Brazilian rock has established itself as a tool for cultural, social, and political reflection. More than a musical genre meant for entertainment, rock— particularly as practiced by the southern Brazilian band—reflects a critical engagement with the historical context in which it emerged, highlighting issues such as freedom, justice, and resistance. The research adopts an interdisciplinary approach, exploring the relationship between music and Law, anchored in historical, legal, and cultural elements that shaped decisive moments in Brazil's history. Using an analytical methodology based on the works of authors like Marcos Napolitano, the study examines aspects such as lyrics, melodies, and the creative context of the songs to identify representations of fundamental rights, including freedom of expression and the right to movement. Additionally, it considers elements of criminal responsibility and the principle of presumption of innocence, symbolically and poetically embedded in the band's music. The research seeks to demonstrate that the work of Engenheiros do Hawaii transcends musical art, specifically as a channel of critique against inequalities and imposed repressions. In conclusion, it is argued that Brazilian rock, exemplified by the work of Engenheiros do Hawaii, is more than a reflection of its time: it is a cultural expression that actively contributes to the dialogue with Law, inspiring reflections on freedom, citizenship, and justice. This study reinforces the relevance of music as a source of analysis to identify representations of legal notions.

    Juízo 100% Digital nos Juizados Especiais Cíveis sob a ótica dos princípios da Lei 9.099/95 e do acesso à justiça

    This work arises from the following problem: do technology and new digital tools truly contribute to access to justice for the target audience of the special civil court? In this context, the general objective of the research is to analyze the impact of the digitalization of judicial processes, specifically the 100% Digital Court, on the Special Civil Courts, in light of the principles established by Law No. 9,099/1995 and the right to access justice. The methodology used includes a qualitative and quantitative approach, employing a literature review based on scientific articles, theses, books, dissertations, and reports from the National Justice Council (CNJ) regarding the implementation of the digital system in the Judiciary. The results obtained demonstrate that, although digitalization brings significant advances in terms of efficiency, speed, and procedural economy, it also highlights the persistence of barriers that limit access to justice. The phenomenon of digital exclusion, exacerbated by socioeconomic inequality, still affects the ability of part of the population to effectively interact with the digital judiciary system. Technologies such as artificial intelligence and process automation are beneficial but need to be implemented with attention to the needs of all users, especially the most vulnerable. In conclusion, this work emphasizes that the 100% Digital Court has the potential to promote a more accessible and efficient justice system, provided it is accompanied by measures that ensure digital inclusion and the training of citizens in using new tools. Therefore, it is essential for the Judiciary to continue developing strategies that ensure the effectiveness of the right to access justice, overcoming the limitations imposed by digital and social inequalities.

    Blockchain, criptomoedas e segurança da informação: análise da Lei nº 14.478/2022 como marco regulatório inicial no ordenamento brasileiro

    The present undergraduate thesis addresses the theme "Blockchain, Cryptocurrencies, and Information Security: Analysis of Law No. 14.478/2022 as the initial regulatory framework in the Brazilian legal system." The main objective is to explore the various applications and benefits of blockchain technology beyond the scope of cryptocurrencies, examining it from a legal perspective. Originally developed to support the functioning of cryptocurrencies, blockchain is an innovative technology that allows decentralized, transparent, and immutable data recording. In this thesis, we will analyze how this technology has been regulated by the Brazilian legal system. The research will focus on the challenges of adopting blockchain in financial sectors under the umbrella of legal regulation, as well as its ability to enhance the efficiency, security, and transparency of financial processes. Additionally, we will examine the necessary mechanisms to prevent crimes and frauds involving cryptocurrencies, as well as the Brazilian legislative approach to such issues. Through this research, we aim to provide a comprehensive view of the disruptive potential of blockchain and how this technology can transform the way we interact and conduct business in various fields. Moreover, the study aims to contribute to a broader understanding of the importance of blockchain as a powerful tool to drive financial technological innovation.

    Liberdade de expressão e responsabilidade das plataformas digitais: o caso X (antigo Twitter) e a decisão do STF

    This monograph aims to analyze freedom of expression, hate speech, and the obligation to comply with Brazilian judicial decisions, using the controversial decision by Minister Alexandre de Moraes of the Supreme Federal Court (STF), which ordered the suspension of the X (formerly Twitter) platform’s activities in Brazil, as a case study. The research explores the necessity of respecting national legal sovereignty, in a context shaped by the growing influence of digital platforms in contemporary society and the challenges they pose to the enforcement of national laws. The decision to suspend X sparked an intense debate on the limits of freedom of expression and the role of digital platforms in data protection and combating misinformation - key issues that this study addresses. To achieve this, the research analyzes the judicial decision in light of the Brazilian Internet Civil Framework, the General Data Protection Law (LGPD), and the constitutional principles governing freedom of expression and national sovereignty. The goal is to understand the challenges and contradictions inherent in content moderation on digital platforms, the responsibility of internet companies to comply with Brazilian laws, and the guarantee of the effectiveness of judicial decisions in the digital environment. By analyzing the X case, this study seeks to contribute to the ongoing debate on the regulation of digital platforms and the protection of national legal sovereignty in the internet age, where borders become increasingly blurred and challenges to the application of the law multiply.

    Smart contracts e Direito no Brasil: desafios e aspectos jurídicos

    This study analyzes the legal landscape of smart contracts in the context of Brazilian law. The starting point for this analysis is article 425 of the Civil Code, which allows parties to stipulate atypical contracts, provided that the general norms of the code are observed. From this basis, the question arises whether smart contracts can be considered a category of atypical contract, subject to the validity requirements stipulated in article 104 of the Civil Code: capable agent, lawful, possible, determined or determinable object, and prescribed form or not forbidden by law. However, this simple reference to contracts in the Civil Code proves insufficient to deal with the intrinsic complexity of smart contracts, notably their characteristic of immutability. Although still rarely used in Brazil, the issue of the legality of these contracts and the need for regulation in the Civil Code are relevant topics. In response to this legal gap, in 2022, bill 954/2022 was introduced in the Chamber of Deputies, aiming to initiate the regulatory process regarding these institutions. This study concludes that smart contracts represent a new institution in global contract law, bringing benefits and challenging the current Brazilian legal system. Therefore, it is crucial to question how to properly apply and regulate smart contracts in contractual relations, in accordance with national legislation, as this technology continues to evolve and be adopted in the country's legal landscape.

    Responsabilidade civil na era das inteligências artificiais: análise da coleta indevida de dados pessoais no Brasil e o caso TikTok

    The present monograph examines the application of civil liability in the context of artificial intelligence (AI), with an emphasis on the improper collection of personal data and the legal challenges arising from disruptive technological practices, highlighting algorithmic opacity and the absence of specific regulations to govern its development and operation. As a reference, the study addresses the conviction of the TikTok platform for the improper collection of sensitive personal data conducted without the unequivocal consent of data subjects. Divided into three chapters, the work revisits the foundations of civil liability, exploring its essential elements – human conduct, damage, causal link, and fault – and examining the obstacles to its application to emerging technologies. Subsequently, it investigates Brazilian legal frameworks for data protection, with emphasis on the Consumer Defense Code, the Internet Civil Framework, and the General Data Protection Law. The final chapter delves into the TikTok case, investigating the identified irregularities, the platform's accountability, and the implications of this episode for AI regulation and personal data protection. It concludes that, although civil liability provides a relevant basis for mitigating the damages arising from intelligent systems, the absence of specific regulations undermines legal security and the protection of fundamental rights. The study highlights the need for legislative improvement to address the peculiarities of AI, reconciling technological innovation with the protection of human dignity in the digital environment.

    Os desafios da efetivação do direito à privacidade digital no Brasil: proteção de dados para além do consentimento, uma análise à luz da Lei 13.709/2018

    This dissertation addresses the challenges of enforcing the right to digital privacy in Brazil, focusing on data protection beyond consent under the framework of the General Data Protection Law (Law No. 13,709/2018). Initially, it contextualizes the historical transition of societies, from agricultural to the information society, emphasizing the centrality of information as an economic asset and instrument of power in contemporary times. In this context, personal data is analyzed as an extension of human personality, requiring a normative approach that promotes dignity, autonomy, and informational self-determination. The research identifies the limitations of the consent-centered model, especially considering informational asymmetries and the rise of technological surveillance. Furthermore, it examines the impact of new technologies on behavioral profiling and the risks of algorithmic discrimination, highlighting the hypervulnerability of data subjects. Finally, the dissertation proposes a systemic approach to personal data protection based on risk regulation, focusing on dynamic principles and overcoming the dichotomy between public and private spheres. This proposal reflects the need to adapt Brazilian legal frameworks to the ethical and legal challenges posed by the digital economy and the datafication of social relations, consolidating data as an autonomous category of personality rights.

    The political marginalization of women systematically undermines the realization of a truly democratic Rule of Law. It is important to note that the effectiveness of affirmative policies enshrined in legal frameworks is hindered by processes of stigmatization and exclusion of women from the political and electoral arenas. In this context, the application of anti- discrimination law as a hermeneutic tool serves as a robust and legitimizing framework for ensuring the effective enforcement of legal guarantees within an exclusionary society. This research employed a rigorous bibliographic methodology to conduct a critical analysis of this issue. Specifically, the study aims to assess the underrepresentation of women in politics and the persistent violence faced by female officeholders and candidates. From the perspective of anti-discrimination law, the examination of political representation in the municipality of Itapuranga is essential for understanding the local dynamics that directly impact the women of this region.

    NUPIA: a instituição da autocomposição de conflitos no Ministério Público de Goiás

    The growing search for alternative conflict resolution methods aims to reduce disputes and offer more agile and effective solutions to satisfy rights. In Brazil, the Public Prosecutor's Office has played a fundamental role in this movement, particularly through the permanent centers for encouraging self-composition (NUPIA). These centers promote the use of mediation and conciliation as alternatives to traditional judicial processes, fostering social peace and alleviating the burden on the Judiciary. The state of Goiás has stood out in implementing these methods, with its Public Prosecutor's Office, through NUPIA, being one of the main agents in promoting conflict self-composition. The exponential increase in cases in Brazil has significantly overburdened the Judiciary, leading to delays and often dissatisfaction among the parties involved. Self-composition methods, such as conciliation and mediation, emerge as efficient tools to relieve the judicial system and improve the quality of justice provided. The Public Prosecutor’s Office of Goiás, by promoting self-composition, has contributed to this context, becoming a key player in transforming the provision of judicial protection. However, implementing these practices faces challenges that must be overcome for these methods to be more widely accepted and utilized. This monograph's general objective is to analyze the role of NUPIA as a tool for encouraging conflict self-composition. The specific objectives include examining the self-composition mechanisms used, assessing the challenges in implementing these practices, and verifying the practical impacts of this initiative on the legal and social context of Goiás. The study is justified by the need to analyze the functioning of an innovative center, which can serve as a reference for other regions, helping to improve the effectiveness of public policies aimed at peaceful dispute resolution.

    Lawfare de gênero: as “novas” formas de violência de gênero contra as mulheres

    En Brasil, aunque se han ratificado convenciones internacionales que protegen los derechos de las mujeres, la adopción de una medida legislativa y legal necesaria para erradicar la violencia de género no se produjo hasta 2006 y se centró en las formas de violencia doméstica, con la creación de la Ley N° 11.340 - Ley Maria da Penha. A pesar de estos avances, todavía existen diversas formas de resistencia a su implementación. Según la teoría del lawfare de género (Mendes; Dourado, 2022), la cotidianidad histórica brasileña está marcada por la persecución de las mujeres, siendo el Derecho utilizado para debilitarlas, menospreciarlas y violarlas. Desde esta perspectiva, se entiende que existen otras formas de violencia de género contra las mujeres, que no son caracterizadas ni combatidas formalmente. Desde la perspectiva de las teorías de género y del lawfare de género, este trabajo tiene como objetivo comprender las clasificaciones de violencia no previstas en la Ley Maria da Penha, a saber: violencia procesal, violencia institucional y violencia vicaria. Al mismo tiempo, aplicar los "nuevos" conceptos de violencia de género contra las mujeres a casos públicos y notorios publicados en línea, con el fin de investigar la verosimilitud de las teorías, así como la correlación entre las respectivas violencias. Cabe mencionar que este trabajo fue producto de la Iniciación Científica realizada con el Observatorio Regional de Políticas Públicas de Combate a la Violencia de Género en el Campus Goiás/UFG. Desde esta perspectiva, el principal método utilizado en este estudio fue una revisión integradora, basada en dos parámetros: una revisión de la literatura teórica y empírica, combinando los conceptos de violencia con el estudio de casos brasileños públicos y notorios. Como resultado, se entendió que las asimetrías de género son transversales al Derecho y a las instituciones públicas, siendo dichas violencias obstáculos para la realización de los derechos de las mujeres. En la investigación empírica la incidencia de las formas también se observó en tres casos: Titi Müller versus Tomás Bertoni, Luana Piovani versus Pedro Scooby y Ana Hickmann versus Alexandre Correa. Además, se identificó una correlación entre las "nuevas" formas, denominándose el fenómeno como "red de violencia".

    O medo das saídas temporárias: uma análise crítica ao direito da saída temporária da pessoa encarcerada na realidade punitivista do sistema penal brasileiro

    The project ahead analyzes the Brazilian criminal execution with a focus on temporary leave, a right of the arrested person provided by the Law of Criminal Enforcement. The objective is to investigate how the institute, which aims to maintain the harmony of the prisoner with the progression of the regime and the fulfillment of the execution, in a more humane way, has been threatened legislatively, as by the recent Law 14,843, of April 11, 2024, which restricted temporary leaves. The research addresses the normative provisions of temporary leaves before and after the restriction, demonstrating the requirements of concession and revocation that confer it as a right. An analysis of the penitentiary data revealed that the rates of non-returns during temporary leaves are minimal, denying media and political discourses that this right contributes to escaping prison and an increase in urban violence. The project uses a quantitative and qualitative approach to identify how these discourses are contrary to statistical data which promotes the approval of laws, discussing the social construction of criminalization by the creation of the stigma conceptualized by Erving Goffman who, promoting fear, validates punitivism through the emergency voice of "punitive populism" and fixes norms with the tool of legislative symbolism, maintaining the political power of dominant groups. It is concluded that temporary leaves are fundamental for the accountability of the prisoner during the progression of the regime and an important assistance for the humanization of the custodial sentence, highlighting the need for a critical and informed discussion on the subject in the socio-political context.

    Movimento feminista negro, questões ético-raciais e sexistas

    Brazil was deeply influenced by European currents, whose traces resonate in the Brazilian social structure, keeping the models of the colonialist empire intact. The marks of exploitation and inequality left by the enslavement of people still persist today. This work aims to present colonialism in the imposition of ethical-racial issues, highlighting racism, sexism, misogyny and transphobia. Based on the contributions of renowned authors who discuss the topic, drawing a parallel between the experiences of people marginalized (black) by colonization and the marks that remained present in the 21st century. The struggles of the black feminist movement, throughout the ages, emphasize the discussion of race as a driver of change for the black population. To support this study, bibliographic and documentary research was used, including the review of books, articles and legislative documents that regulate racism as a non-bailable crime, the result of the incessant battles for fundamental social rights. The continuous need for demands from marginalized communities and State mediation to implement public policies that support the guarantees achieved and firm the inclusion of black women in society is evident.
