dc.description.abstractThis research job intends to investigate the effectiveness of class actions at Itumbiara-GO judicial district in Brazil during the years of 1999 to 2008. It has been done both a doctrinaire and jurisprudential research and a research at the archives of the local Public Ministry, as well as at the archives of the local judiciary court. The data overview made possible to answer the problem indicated at the beginning of the job. If there were initiatives at the last decade, in order to look for the collective judiciary protection; if the legal legitimated organs have accomplished their role acting in defense of the diffuses; collectives and homogeneous interests; if the judiciary has corresponded positively in what matters class actions managed locally; if there have been effectiveness in judiciaries initiatives and this results in benefits desired. The results question the issue of accessibility to justice and effective judicial protection.pt_BR,en_US
dc.description.resumoO presente trabalho tem por objetivo investigar sobre a efetividade das Ações Coletivas na Comarca de Itumbiara/Goiás no período compreendido entre 1999 a 2008. Para tanto além da pesquisa doutrinária e jurisprudencial sobre a temática, realizou-se também uma pesquisa de campo que investigou arquivos do Ministério Público Local bem como do Fórum Local. O levantamento dos dados possibilitou responder a problemática colocada no início do trabalho, quais sejam: se houve iniciativas, nesta última década, pela busca da tutela jurisdicional coletiva; se os legitimados legais têm cumprido seu papel, agindo na defesa dos interesses difusos, coletivos e individuais homogêneos; se o judiciário tem correspondido positivamente no que tange às ações coletivas processadas em âmbito local; se há efetividade das iniciativas jurisdicionais, resultando nos benefícios almejados. Os resultados colocam em xeque a questão da acessibilidade à justiça e da efetividade da tutela jurisdicional.pt_BR,en_US
