Resumo

The present work aims to analyze the recognition of algorithmic subordination in uberized work relations, aiming at expanding the concept of subordination to an eventual protective regulation of these new work conformations. To achieve this objective, an overview of the factual-legal requirements of the employment relationship is created, to demonstrate the normative paradigm base for identifying an employment relationship to be protected by the labor legal apparatus. In the same way, the characteristics of the so-called uberized labor relations will also be described, in order to emphasize the conceptual crisis of subordination. The research method used was dialectical-argumentative and the methodology consisted of a bibliographical review of articles and legal dissertations. It is identified that these new work configurations are in an area of deregulation or incipient regulation, which compromises the scope of labor protections. Thus, this study sought to overcome the paradigm of classical legal subordination, with the aim of proposing the recognition of algorithmic subordination in relationships via digital platforms.
