| dc.description.abstract | This article, through bibliographical research, documentary analysis and hermeneutics approach, aims to highlight the problem of climate emergency and to conduct a dialogue between Climate Law and the Rights of Nature, to highlight that there is interdependence between the integrity of the Climate System and the Ecological Integrity, and that both, in reality, aim at a life in balance (ecological balance), in harmony with Nature and with intergenerational concern. The autonomous protection of Nature (jus cogens) prescribes the need for production, development and consumption models to be disconnected from environmental degradation. Finally, the conclusion is that the principle of harmony with Nature is the enunciation of every environmental, ecological or climatic rule and stems from the autonomous protection of Nature. It is a holistic and transversal principle, which promotes the greening of all Law, including, therefore, Climate Law and the duty to protect the integrity of the Climate System. | |
| dc.description.resumo | Este artigo, por meio de pesquisa bibliográfica, análise documental e abordagem hermenêutica, objetiva evidenciar o problema da emergência climática e realizar um diálogo entre o Direito Climático e os Direitos da Natureza, para destacar que há interdependência entre a integridade do Sistema Climático e a Integridade Ecológica, e que ambos, em realidade, objetivam a uma vida em equilíbrio (equilíbrio ecológico), em harmonia com a Natureza e com preocupação intergeracional. A proteção autônoma da Natureza (jus cogens) prescreve a necessidade dos modelos de produção, desenvolvimento e consumo se desvincularem da degradação ambiental. Por fim, a conclusão é que o princípio da harmonia com a Natureza é a enunciação de toda regra ambiental, ecológica ou climática e decorre da proteção autônoma da Natureza. É princípio holístico e transversal, que promove a ecologização de todo o Direito, incluindo, portanto, o Direito Climático e o dever de proteção da integridade do Sistema Climático. | |
