| dc.description.abstract | The Civil Code of 2002 introduced in the Brazilian law the subject of the attended human re-production. However, appears the problem about the paternity in the main forms of attended reproduction, especially in the artificial insemination with the mate-rial of an anonimate donor. The present article has the goal to study the artificial insemination with the ma-terial of an anonimate donor in the Civil Code of 2002 and the consequences in the filiation right, using the affective entail to establish the filiation. Therefore, it is important to study the filiation principles, the concept of filiation, as well as the regulation of the artificial in-semination with the material of an anonimate donor in different countries. With the new civil law, appea-red some questions about the paternity in the artificial insemination with the material of an anonimate do-nor: Who is the father on this technique? The right of anonymity of the donor must be maintained? | pt_BR |
| dc.description.resumo | O Código Civil de 2002 introduziu no direito brasileiro o tema da reprodução humana as-sistida. Todavia, surgiu a dúvida sobre quem seria o pai nas principais formas de reprodução assistida, especialmente na inseminação artificial heteróloga. O presente trabalho objetiva estudar a insemina-ção artificial heteróloga no Código Civil de 2002 e as conseqüências no direito à filiação, utilizando-se do vínculo afetivo para o estabelecimento da filiação. Ademais, faz-se necessário o estudo dos princípios da filiação, do seu conceito, bem como da regula-mentação da inseminação artificial heteróloga em diversos países. Com a nova lei civil, surgiram várias perguntas sobre a paternidade na inseminação artifi-cial heteróloga: quem é o pai nesta técnica? O direito ao anonimato do doador deve ser mantido? | pt_BR |
