Trajetória legislativa da fiscalização da internação psiquiátrica no Brasil

Abstract

This article analyzes legislation on psychiatric hospitalization in Brazil in the 19th, 20th, and 21st centuries, seeking to determine how the mechanisms for monitoring psychiatric hospitalization have changed over time. The objective is to demonstrate that these changes occurred in accordance with the socioscientific standards for treating mental disorders prevalent in each era. The conclusion is that the psychosocial care model established by Law No. 10,216/2001, and especially its directive on exceptional hospitalization, should guide the monitoring of psychiatric hospitalization so that it can truly exercise control over this type of treatment. The research is bibliographical and focuses on legislation and scientific articles addressing the topic. The methodology employed is essentially argumentative, particularly from a historical perspective.
