dc.description.abstractSeeking to understand the role of the State in protecting and guaranteeing the Human Rights, the present work starts from the problem “Is the Democratic State of Law a potential author of the violations and discrimination that plague Brazilian women?”, To analyze the historical processes of consolidation of women's rights and their internalization by state institutions; investigate actions and omissions of the State and its agents that affect, positively or negatively, these rights; and to verify the hypothesis of violence against women tolerated or practiced by the State in the sphere of the Three Powers, especially the Judiciary. Through a qualitative approach, which used the Historical-Dialectical Materialistic Method, using legal and dogmatic procedures, the research was carried out through Bibliographic Review and Documentary Research. The consolidation of women's rights as Human Rights brought advances towards women's emancipation and enshrined women as citizens. The struggles against violations of women's freedom have been internalized by Brazil through its own historical processes and have affected a series of legislative changes based on the principle of isonomy and human dignity, among which the 1988 Federal Constitution and the protection laws against various forms of violence, arising from criminal law. However, in spite of the significant achievements, the present work, through data collection and graph display related to the active political participation of women in Brazil, reveals that the theoretical notion of equality is far from the factual reality, as the male domination scenario reveals countless material and discursive setbacks, which result in constant violations of women's dignity and affect women's human rights, with emphasis on reproductive and sexual rights. Through analysis of data on the rates of domestic and sexual violence, feminicide and maternal mortality, the study questions whether the state's tolerance, omission or action constitutes, in itself, a form of violence, legitimized through public institutions. In view of the role of the Judiciary in gender relations, a concrete case is investigated through a procedural analysis of the records and discourse, illustrating institutional violence motivated by gender.pt_BR
dc.description.resumoBuscando compreender o papel do Estado na proteção e garantia dos Direitos Humanos das Mulheres, o presente trabalho parte do problema “O Estado Democrático de Direito é um potencial autor das violações e discriminações que assolam as mulheres brasileira?”, para analisar os processos históricos de consolidação dos direitos femininos e a internalização destes pelas instituições estatais; investigar ações e omissões do Estado e seus agentes que incidam, positivamente ou negativamente, sobre esses direitos; e verificar hipóteses de violências contra a mulher toleradas ou praticas pelo Estado na esfera dos Três Poderes, destacando-se o Poder Judiciário. Através de abordagem qualitativa, que utilizou o Método Materialista Histórico-Dialético, valendo-se de procedimentos jurídicos e dogmáticos, a pesquisa foi realizada através de Revisão Bibliográfica e Pesquisa Documental. A consolidação dos direitos das mulheres enquanto Direitos Humanos trouxe avanços para a emancipação feminina e consagrou a mulher enquanto cidadã. As lutas contra as violações à liberdade feminina foram internalizadas pelo Brasil através de seus próprios processos históricos e tem incidido uma série de mudanças legislativas pautadas no princípio da isonomia e dignidade da pessoa humana, dentre as quais destacam-se a Constituição Federal de 1988 e as leis de proteção contra as diversas formas de violência, oriundas do Direito Penal. No entanto, apesar das conquistas significativas, o presente trabalho, através do levantamento de dados e exposição de gráficos relativos à participação política ativa feminina no Brasil, revela que a noção teórica de igualdade está distante da realidade fática, pois o cenário de dominação masculina revelam inúmeros retrocessos materiais e discursivos, que resultam em constantes violações à dignidade feminina e incidem sobre os direitos humanos das mulheres, destacando-se os direitos reprodutivos e sexuais. Através de análise de dados sobre as taxas de violência doméstica e sexual, feminicídio e mortalidade materna, o estudo questiona se a tolerância, omissão ou ação do Estado configura, em si mesma, uma forma de violência, legitimada através das instituições públicas. Em atenção à atuação do Poder Judiciário nas relações de gênero, investiga-se um caso concreto através de análise processual dos autos e de discurso, ilustrando a violência institucional motivada por gênero.pt_BR
