Direito agrário provisório: uma análise das medidas provisórias e o avanço neoliberal no campo pós golpe (2016-2022)

Abstract

This research analyzed the provisional measures issued during the administrations of Presidents Michel Temer and Jair Bolsonaro (2016-2022) that address agrarian issues in Brazil, evaluating possible advancements and setbacks. The study aims to understand the general aspects of these provisional measures, discuss the complexity of the agrarian issue, and analyze how these issues have been handled through this type of instrument, questioning whether it is the most appropriate approach to resolving agrarian conflicts. To address this issue, the historical and inductive methods were employed, based on the assumption that the agrarian question stems from a structural problem of the capitalist mode of production. The research techniques included literature reviews and analyses, as well as studies of secondary data and documents, focusing on the content of the provisional measures and the related dissensions. The results indicate that provisional measures are not effective tools for addressing the complex agrarian issue in Brazil, creating more confusion than solutions, as they do not rely on a broad debate with society or its representatives.
