Instrumentos de criminalização dos movimentos sociais agrários

Abstract

The objective of this work is to present the way in which the criminalization of social movements that are present in the Brazilian countryside takes place, highlighting through the method of bibliographic research which institutional instruments present in Brazilian legal institutes are responsible for the criminalization of social movements in the countryside. For this, a historiographic analysis of the formation of the rural working class in Brazil will be carried out from the Brazilian agricultural land issue from the colonial period to the consolidation of the rural working class in Brazil in the twentieth century, analyzing the formation of the Brazilian peasantry through historical periods, tracing a timeline that will address the analysis of the Brazilian agrarian question considering the colonial period until the enactment of the Land Law, passing through the formation of the peasantry from the Land Law to the end of slavery. In an effort to try to understand the social movements that represent the Brazilian peasantry, the dissertation highlights the fight against large estates promoted by different social movements, whose emphasis and main focus will be on the use of the National Security Law as an instrument for criminalizing the Movement of Landless Farmers - MASTER, of the Peasant Leagues and the Criminalization of the MST - Landless Rural Workers Movement, also instrumentalized by the use of the Penal Code through the Possessive Esbulho and contemporary forms of criminalization of such movements using the Criminal Organizations Law , Anti-Terrorism Law and other institutes covered by a repressive and selective criminal system.
