dc.description.abstractAbstract: This project aims to analyze the legislation on women and their representation in the medieval period from the new reforming ideals of the Church. For that, the Decretum of Gratian, elaborated in the twelfth century, will be used. The Decretum was chosen to define the first ecclesiastical canonical systematization to legislate on the woman and her representation. The theoretical-scientific orientation of this research lies in the perspective of literary treatment, that is, in the construction of a narrative discourse committed to the strategies of misogynistic literature and its influence on ecclesiastical legislation. The proposal is to know the origin of the rhetoric of female representation throughout history and to demonstrate that this representation is ideological and carries in itself a misogynist treatment, consolidated in the patristic literature and its medieval legacy, rooted in Literature and in the thought of antiquity classical and Judeo-Christian biblical tradition, starting from the hypothesis that the antifeminist discourse was consolidated in the ecclesiastical legislation with pretension to regulate the situation of the woman of limited and excessively rigid and generalizing form, away from her the fair ideal. The assumption is to suggest a return to the origins of the rhetoric of the inferiorization of women, in an attempt to humanize the Law, in order to explore new ways to restructure the premises and dictates of this representation. To know the origins of this antifeminist discourse, the resources to be examined belong to the field of rhetoric, and will be concentrated in the topoi of misogyny that architects the discourse of the Decretum. There will be an incursion into the text of the Decretum, especially in the second part, which deals with the ecclesiastical process and the jurisdiction of the regime of Church property, marriage and penances, in which each case is initiated with the exposition of an imaginary case practical analysis to which the author makes follow the analysis of the several questions that need to be decided to solve it, highlighting, in this, some of these topoi. The importance of this rhetorical and stylistic study is to recognize marks of a traditional misogynistic language that is legally disseminated in Literature and in the legal field.eng

dc.description.resumoEste projeto tem como objetivo analisar a legislação sobre a mulher e a sua representação no período medieval a partir dos novos ideais reformadores da Igreja. Para tanto, será utilizado o Decretum de Graciano, elaborado no século XII. O Decretum foi escolhido por definir a primeira sistematização canônica eclesiástica a legislar sobre a mulher e sua representação. O direcionamento teórico-científico desta pesquisa se situa na perspectiva do tratamento literário, isto é, na construção de um discurso narrativo comprometido com estratégias próprias da literatura misógina e sua influência na legislação eclesiástica. A proposta é conhecer a origem da retórica da representação feminina ao longo da História e demonstrar que essa representação é ideológica etraz em si um tratamento misógino, este consolidado na literatura patrística e no seu legado medieval, com raízes na Literatura e no pensamento da Antiguidade clássica e na tradição bíblica judaico-cristã, partindo da hipótese de que o discurso antifeminista foi consolidado na legislação eclesiástica com pretensão de regular a situação da mulher de forma limitada e excessivamente rígida e generalizante, afastando dela o ideal justo. O pressuposto é sugerir um retorno às origens da retórica da inferiorização da mulher, numa tentativa de humanização do Direito, a fim de explorar novos meios para reestruturar as premissas e os ditames dessa representação. Para conhecer as origens desse discurso antifeminista, os recursos a serem examinados pertencem ao campo da retórica, e serão concentrados nos topoi da misoginia que arquitetam o discurso do Decretum. Será feita uma incursão no texto do Decretum, em especial na segunda parte,que se ocupa do processo eclesiástico e da jurisdição do regime de bens da Igreja, do casamento e das penitências, em que cada causa é iniciada com a exposição de um imaginário caso prático ao qual o autor faz seguir a análise das várias questões que precisam ser decididas para solucioná-lo, destacando-se, nisso, alguns desses topoi. A importância desse estudo retórico e estilístico consiste em reconhecer marcas de uma linguagem misógina tradicional que se dissemina, na Literatura e no campo jurídico, legadamente.eng
