Resumo

This research project aims to analyze the evolution of agrarian legislation, from the discovery of Brazil, through sesmarias, through the Land Law, Constitutional provisions, to the present day and to draw a parallel between the actions in the agrarian area of the last 04 years in cities in the interior of Rio Grande do Sul and the impact generated by the lack of specialized Courts in Brazil and the consequent autonomy of Agrarian Law, despite the existence of a provision in the Federal Constitution, understanding the important role of Power Judiciary in preserving the fundamental rights of individuals, especially those involving relations between man, rural property and land use. Furthermore, there is a need for speed in resolving judicial conflicts involving agrarian issues. It also discusses the fundamental principle of Agrarian Law, that is, the social function of property and its multidimensional purpose. It is noted that the research will expose and discuss concrete data on actions proposed in the Judicial Courts of the State of Rio Grande do Sul. Finally, a model is proposed to implement the Constitutional commands of procedural speed and autonomy of Agrarian Law, emphasizing the essential need to improve judicial provision, through judges who are more prepared and knowledgeable about the particularities of agrarian issues, which will generate, as a logical consequence, greater speed in delivering the response to each person of those under jurisdiction who need the State-Judge.
