Competências federativas e responsabilidade municipal na oferta de creches e pré-escolas: o regime de colaboração e a necessidade de apoio dos estados-membros

Abstract

This article examines how federalism and the collaboration regime impact the creation and implementation of public policies for early childhood education in Brazil, focusing on the provision of daycare and preschool slots. The 1988 Federal Constitution and the Law of Guidelines and Bases of National Education assign municipalities the responsibility for providing daycare slots, with technical and financial support from the federal government and the states. However, ambiguities and a lack of clarity in these regulations have led to divergent interpretations regarding the roles of the federative entities. The study shows that the division of responsibilities and resources among the federal government, states, and municipalities affects these entities' ability to meet the growing demand for daycare and preschool slots. Finally, the article emphasizes the importance of clear regulation to ensure cooperation among different levels of government and to improve collaborative governance for the expansion and enhancement of early childhood education in daycares and preschools.
