Resumo
This work analyzes the legal guarantees on the teaching of gender and sexuality in Brazilian
schools with a focus on their ability to protect teachers against persecution based on the discourse
on “gender ideology”. Through qualitative, bibliographic and documentary research, the
development of educational policies on the subject between the 1990s and early 2020s was
examined. The work highlights the moral panics fomented by discourses such as the “gay kit” from
the 1990s onwards. 2010 and its results in the construction of an anti-gender political agenda,
which was proven in the criminalization and persecution of teachers, producing an inhibiting effect
against the teaching of the subject. It is concluded that existing laws are not sufficient to guarantee
inclusive education and the protection of teachers. The need for legal and political articulation
between the federal, state and municipal spheres is demonstrated in the promotion of public
policies that promote human rights and diversity, in addition to strengthening public education and
the professional stability of teachers.
