Resumo
This article aims to investigate whether traditional populations can be included within a political, sociological, anthropological, and legal understanding of minorities, within the context of socio-environmental conflicts. The relevance of this study liesin the possibility of recognizing a situation of legal and social vulnerability of certain groups, which would consequently bring about the necessity for special state protection, both legal and judicial. This analysis is made in the light of political ecology and the coloniality of nature, with bibliographic review, case study, documentary research, in the strict sense, legal and jurisprudential. The work was developed in four parts, one to develop the concept of minorities, one to develop the concept of socio-environmental conflict, one to the case study and one to analyze the situation of lack of fundamental rights of traditional populations and its possible rectification. The results obtained prove that traditional populations conform to the concept of minorities and, as such, require special protection.
