Resumo
The present work is anchored in the concept of access to justice to conclude that the judicial
provision is a public service, to be provided by the State, and therefore must comply with the
constitutional principles that govern Public Administration and the model of managerial public
administration, so that the needs of citizens are met, as they are the customers of the public
service provided by the Judiciary. In view of this, it aims to analyze the feasibility of
implementing positions of Auxiliary Judge in the Court of Justice of the State of Mato Grosso
as a way of guaranteeing access to justice through an efficient and effective judicial provision.
For that, a descriptive research was carried out, with a qualitative approach, using
documental research and field study as a method. As a primary data collection technique, a
panel of experts was used, with interviews conducted with 12 lawyers, presidents of
subsections of the OAB/MT, considered relevant stakeholders of the process. The results
demonstrate that other State Courts of Justice already adopt the positions of Auxiliary Judge;
the creation of auxiliary judge positions would have an impact on the capacity of judges at the
Court of Justice of the State of Mato Grosso; and that lawyers, as stakeholders, perceive the
judicial provision by the Judiciary of Mato Grosso as slow, understanding that the creation of
positions of Auxiliary Judge would have a positive impact on the efficiency and effectiveness of
the judicial service in the State. As a Technological Technical Product, a law proposition was
created, which will be presented to the Court of Justice of the State of Mato Grosso. It is
concluded that, from the perspective of lawyers in Mato Grosso, the creation of positions of
Auxiliary Judge is a measure that would positively impact the efficiency and effectiveness of
jurisdictional provision, improving the quality of the justice service provided by the State
Court of Justice from Mato Grosso.
