Jurimetria e Ministéro Público: levantamento empírico e estatística como ferramentas necessárias à tomada de decisão estratégica institucional

Abstract

This paper discusses the necessity of overcoming the legal practice centered on a dogmatic approach grounded in the argumentative manipulation of the abstract normative plan. It argues that legal norms are not logically deduced from pre-existing normative meanings; rather, interpretation is a creative process influenced by extralegal factors that condition the practical application of the law, in line with Legal Realism. In this regard, jurimetrics emerges as an alternative to understanding the legal phenomenon in its entirety through the use of an empirical statistical method suited to the uncertainty of the Law. It advocates for the use of Jurimetrics by the Public Prosecutor’s Office to substantiate strate gic decisions and ensure the realization of rights, achieving effective, observable, and measurable results from its actions.
