Análise descritiva de carta de serviços, manuais e POPs utilizados pelo sistema de investigação criminal brasileiro: onde está o(a) farmacêutico(a) na perícia criminal?

Abstract

The production of expert evidence is an important part of a criminal trial. To maintain the reliability and fidelity of the evidence, the steps in the chain of custody must be executed by forensic experts with sufficient technique and knowledge so that the results serve as a judicial framework. Among these, pharmaceutical knowledge is crucial. If the execution of the chain of custody steps is not carried out according to the precepts of the Code of Criminal Procedure (CPP) and its amendments, it may become invalid and illegal. To mitigate possible biases in the production of expert evidence, superintendencies, departments, and state and federal agencies have produced service charters, manuals, and SOPs (Standard Operating Procedures) in order to adapt and standardize the actions of forensic experts, public agents, and/or police officers who participate in these steps. Therefore, this work aims to carry out a descriptive analysis of documents made available by official bodies of the States and the Union in order to improve the process of producing expert evidence. It highlights the need to value the pharmaceutical professional as well as the need to include the area of ​​forensic pharmacy in official bodies and universities. It advocates for the chain of custody, when required in a criminal process, with solid, legitimate and unassailable foundations so that justice remains impartial and impersonal in the analysis of the facts and veracity in the criminal judicial process.
