Resumo
In Brazil, there is no legislation that regulates assisted human reproduction. In this
way, the parties are subject to ethical rules that are assigned to fertility institutions.
The Federal Council of Medicine, through resolution Nº 2.168/2017, requires the
anonymity of the genetic material donor for insemination, wich claims that this
imposition protects the parties from future interferences in family relationships and
also preserves the donor’s intimacy.
However, this work aims to comtemplate, through a deductive approach and
qualitative bibliography reasearch, the fundamental right to personality, wich the right
to child’s personal and genetic identity or the right of the genetic material donor
should prevail; being necessary to change the legislative wording of the articicle 27 of
the Statute of Children and Adolescents, providing the right of identity with no bond of
kinship and sucessory effect.
