Item Adolescente em conflito com a lei: uma análise do direito à ampla defesa em Goiânia/Goiás(Universidade Federal de Goiás, 2017-08-31) Borges, Lélia Moreira; Durães, Telma Ferreira do Nascimento; http://lattes.cnpq.br/6386493067782696; Durães, Telma Ferreira do Nascimento; Bonesso, Márcio; Oliveira, Dijaci David deThis dissertation had as its objective verify whether the adolescents submitted to the institutionalization measures in Goiânia, Goiás – Brazil, were guaranteed their right to the adversarial principle and full defense in their trials. The empirical field of this investigation consisted of the analysis of cases filed between the periods of 2014 to 2016, and the observation of hearings carried out in the infractions court of Child and Youth Court of Goiânia, GO and interviews with public defenders. The Federal Constitution of 1988, the Child and Adolescent Statute, Criminal Code, Criminal Procedure and Civil Procedure Codes were used as the main legal references for this study. As theoretical support, Emílio G. Mendez, Pierre Bourdieu and Loïc Wacquant were also used. These references were useful in the understanding of the infraction persecution dynamics operationalized by the security and justice system of the State. As well as that, the understanding of the socio-juridical paradigm in force at each moment of history that justified the penalization of children and adolescents; the concept of field as a social space in competition, subject to internal disputes hierarchically established by the monopoly of the significance of such space, and the intensification of punitive actions by the State allow the perception of the permanence of the irregular situation paradigm in the professionals’ performances and judicial decisions. Decisions marked by inequality between institutions that operate in the juvenile criminal justice system, facing the recent entry of the public defense counsel, not yet totally structured, in the game of signification and legitimation of a trial that is preponderantly inquisitive. It brings loss to the exercise of full defense of the adolescents accused of acts of infraction. Evidence of a mismatch is noticed between the advances in the children’s and adolescents’ acquisition of rights and guarantees and the criminal control operationalized by the juvenile criminal justice system of Goiânia / GO.Item Tráfico internacional de mulheres: violência e representações cotidianas(Universidade Federal de Goiás, 2016-07-01) Peixoto, Maria Angélica; Durães, Telma Ferreira do Nascimento; http://lattes.cnpq.br/6386493067782696; Durães , Telma Ferreira do Nascimento; Vannuchi, Maria Lúcia; Pinheiro, Veralúcia; Junqueira, Ivanilda; Santos, Cleito Pereira dosHuman trafficking appears contemporaneously with one of the most serious social problems of international scope. Human trafficking is inseparable from violence and therefore the analysis of this social phenomenon becomes even more important as society lives in a contradictory moment in which advances coexist with setbacks, as well as the increase of violence with increasing awareness of the same . It is in this context that there is a growth of trafficking in persons and that it reaches certain sectors of the population, especially women, our research focus. Our theme is the everyday representations of women victims of trafficking in persons, understanding by this transfer of people through illegal or deceptive means, whose purpose is the exploitation, especially sexual. To accomplish this task, we use the dialectical method as a methodological framework and the theory of everyday representations, derived from historical materialism as the main theoretical reference. The dialectical method was present in all the way, allowing a totalizing vision of the process (which referred to the study of contemporary capitalism, explanation of the relationship between society and violence, everyday representations and society) and interviews. Historical materialism was the analytical basis of daily representations and contemporary. The theory of consciousness developed by Marx, part of historical materialism, was the basis for the discussion of everyday representations and its consequences. The theory of everyday representations possible to analyze in more depth the production and reproduction of the discourse of the victims interviewed in a totalizing and comprehensive approach. Similarly, the main research technique used, the interpretive interview, developed within the theory of everyday representations enables a wider of the interviewees perception, not judging their claims through isolated lines stretches but a rich totality that seeks to rescue personal information, biographical, cultural, beyond the representational and semiconscious, forming a whole that allows a totalizing approach. The overall aim of the thesis aimed to find out what everyday representations of violence related to trafficking of women who were victims of the same. With this goal in mind, I conducted interviews and the analysis of the same, based on the theoretical framework defined above, and thus we come to our results. As research with everyday representations not demand a large number of interviews, as in all qualitative research, this number was sufficient. The use of interpretive interview, which brings a greater amount of issues and more general aspects of the interviewed life makes this even more true. Through an in-depth analysis of the five interviews, I realized that everyday representations of the interviewees point to the perception that trafficking is a form of violence, as well as the provision of sexual services abroad is seen as violence by the majority. Thus, everyday representations of the interviewees show a perception that violence permeates the relationship in international traffic and also - except two interviewees who in this regard showed contradictions - the provision of sexual services. The research, therefore, could meet its objectives and deliver a presentation of everyday representations of violence of women victims of international trafficking.Item Migração e trabalho doméstico: trajetórias laborais de mulheres latino-americanas na Espanha(Universidade Federal de Goiás, 2018-08-21) Rodrigues, Thaysa Andréia de Miranda; Durães, Telma Ferreira do Nascimento; http://lattes.cnpq.br/6386493067782696; Durães, Telma Ferreira do Nascimento; El Kadi, Nágila Ibrahim; Tosta, Tania Ludmila DiasEsta disertación tiene como objetivo analizar las trayectorias laborales de mujeres migrantes latinoamericanas que viven en España y que trabajan o que ya han trabajado como domésticas y cuidadoras. Partimos del supuesto de que la intersección entre el género, la raza, la etnia y la clase social ocasionan la segregación de las mujeres migrantes en este sector del mercado de trabajo español. Durante las últimas décadas ha ocurrido un incremento de las migraciones de mujeres latinoamericanas hacia España, un fenómeno que responde a la división sexual e internacional del trabajo, donde los países del Norte demandan mano de obra femenina migrante de los países del Sur global para realizar los trabajos de reproducción que su población no está dispuesta a realizar. Como resultado de la división sexual del trabajo y de las desigualdades de género presentes en ambas sociedades – de origen y de destino – las mujeres son las principales encargadas por el trabajo doméstico y de cuidado, de manera que la mayoría de las migrantes son madres que dejan a sus hijos bajo el cuidado de otras mujeres en sus países de origen. Así, la migración supone enfrentar trabajos precarizados y mal pagos, lo que a su vez contribuye para que las migrantes pasen largos periodos de tiempo separadas de sus familias. Consecuentemente, la maternidad y el cuidado para con aquellos que se quedan pasa a ser ejercidos desde lejos, mediante la comunicación diaria por el teléfono y por internet y también a través del envío de remesas. The first group is responsible for the restrictive measures of liberty in detention centers. The second keeps track of community service provision and assisted liberty measures in reference centers for social assistance. This is an analysis of these professionals perceptions about their work experience, the relationship established with teenagers, their explanations about the reasons of the engagement of teenagers in infractional acts and their representation about legislation on children and adolescents. Through a qualitative approach, an interviews set was considered with each group as data source for the analysis. Also quantitative INFORMATION which describes the general framework of the socio-educational system were used ONLY contextually. This analytical effort resulted in the comprehension that the closed environment reproduces the criminal liability problem, while the open environment reproduces the logic of marginal inclusion. From this context, it was observed the way how each group builds a narrative that gives meaning to their actions and elaborate categories that differentiate them from the young people while label these adolescents.Item O sistema nacional de atendimento socioeducativo (SINASE) e os desafios das unidades de internação no Distrito Federal(Universidade Federal de Goiás, 2015-03-27) Silva, Edson Mendes da; Oliveira, Djaci David de; http://lattes.cnpq.br/9145111011143886; Durães, Telma Ferreira do Nascimento; http://lattes.cnpq.br/6386493067782696; Duraes, Telma Ferreira do NascimentoThis present work concerns the actual landscape of Socio-educational System of the Federal District (Sistema Socioeducativo do Distrito Federal) regarding the socioeducational measures related to the implementation of Socio-educational Service National System (Sistema Nacional de Atendimento Socioeducativo - SINASE) within the confinement procedure. The Statute of Children and Adolescents (Estatuto da Criança e do Adolescente - ECA) and therefore the SINASE has been subject to criticism regarding its services to adolescents in conflict with the law and the incompetence to contain the practice of illegal acts among children under 18 years. Two decades following the creation of ECA, its service is still lies behind the expectations contained in the legislation, the difficulties about taking care of those youngsters have been enabling not just perpetuation of legal infringement, but also its aggravation. The way the socio-educational system works not reach his goal of breaking the offense conduct of adolescents in conflict with the law, but only content to stop temporarily the teenager. The route followed by the Socio- Educational System points to the "dehumanization" increasing the service, since the ideal of rehabilitation has been passed over in the course of care, so that the socioeducational measure, has ceased to be an emancipatory means for be in itself an end. The main objective is to understand the new configurations of commercial sexual exploration of teenagers nowadays. For that, we start of the principle that, in the last years, the phenomenon got new configurations, closely in the fact that refers to its notorious fact. The importance of this study is justified by the few researches realized about the theme in national, according to the few studies realized up to this time. In the context of a historical process, we will realize a return of how a concept of commercial sexual exploration of children and teenagers was made or remake in Brazil in the last decades. So, we are defining and distinguing some diferente cathegories of the own concept as exploration, violence, power, injury, sexual work, sexual market, prostitution and anothers. The caracterization of the phenomenon is made by the narratives of the people researched, as well as the teenagers and the envolved actors in the universe as the profissionals that do the question. To contextualize the phenomenon in extent worldwide and national, it is delineation a outlook in base in data collected por some organizations. We also approach the legal goal and the national legislation refers to affront of this problem in Brazil. The methodological course and the implications of work in locus are described and debated. The demation of construction of teenagers’ identities in their many dimentions are comprehended. At least, the diferente modalities of commercial sexual exploration of teenagers are made in the sense to understand their new dinamics and configurations.Item Violência conjugal contra a mulher na perspectiva dos homens encarcerados por essa prática no Complexo Prisional de Aparecida de Goiânia-GO(Universidade Federal de Goiás, 2017-10-31) Sousa, Gaspar Alexandre Machado de; Durães, Telma Ferreira do Nascimento; http://lattes.cnpq.br/6386493067782696; Durães, Telma Ferreira do Nascimento; http://lattes.cnpq.br/6386493067782696; Oliveira, Dijaci David de; Lemos, Carolina Teles; Cardoso, Franciele Silva; Ecco, ClovisThis thesis deals with conjugal violence against women from the perspective of men imprisoned by this practice in the Prison Complex of Aparecida de Goiânia-GO. It is a study characterized as a qualitative approach, whose central question is to understand whether the imprisonment by the Maria da Penha Law influences the way in which men signify conjugal violence against women. In order to answer this question, a bibliographical survey was first made based on the theoretical framework chosen for the conceptualization of "gender", "power", "masculinity", "violence" and "stigma". Subsequently, semi-structured interviews were carried out with thirty men imprisoned in the said Prison Complex for the practice of conjugal violence against women. The files and records of the criminal proceedings to which the interviewees respond were also examined. After the interviews, there was a categorization of the subjects' speeches, which subsidized the analysis undertaken in the thesis. Based on this categorization, which was based on the sociological concepts worked, the following nuclei of interest were defined: a) marital relationship; b) conjugal violence; c) Maria da Penha Law, prison and prospects for the future. For the analysis of the interviewees' speeches, the discourse analysis technique was used. It was concluded that the imprisonment under the Maria da Penha Law does not influence the way in which men signify conjugal violence against women. On the contrary, in seeking criminalization as an end in itself, current legislation does not bring about change, it only breeds the reproduction of traditional ideals, reinforcing the convictions that led men to practice violent behavior. Obviously, it is not disputed that the safety of women in situations of violence is fundamental, so that all aggression must be stopped and its perpetrator blamed. However, this is not simply to restrict the complexity of violent conjugal interactions to the criminal dimension. It is urgent, therefore, to broaden the discussions on the best ways to overcome domestic and family violence against women, beyond the penal system.
